Overview
The probate process is a court supervised administration of the estate of a decedent governed by California law. A personal representative is appointed to collect and distribute the assets of the decedent’s estate. The personal representative is appointed by the will or trust of the decedent or by court order if the decedent died without a will or trust. The personal representative’s authority to sell property depends upon whether they have been granted authority pursuant to the Independent Administration of Estates Act.
